Elders of the shíshálh Nation filed a trespass notice on the Sunshine Coast Community Forest with the RCMP detachment in Sechelt on Thursday, November 28. shíshálh Elders Xwu’p’a’lich (Barbara Higgins) and Mus-swiya (Jamie Dixon) signed the notice.
The notice states that a previous affidavit of May 2, 2012 on contractors Bell Pole Ltd. and Malaspinia Enterprises is waiting to be heard in court scheduled for April 3, 2013.
This stopped any logging for the day on the East Wilson Creek cutblock (EW002). Peace Camp 2 was reopened at the trail head after three people were arrested by the RCMP for violating the injunction on Tuesday.
Also filed was a declaration stating that "the Elders Council will speak to and address protocols on behalf of the people. The nimulh shíshálh tl'extl'ax-min or Elders Council will direct the affairs, authority and autonomy of the Nation from this time forward." This authority is not recognized by the shíshálh Council.
The Council issued the following statement :
The Chief and Council of the shíshálh Nation are the elected authority. They act on behalf of the shíshálh Nation in respect of matters concerning the shíshálh Nation, including our unextinguished Aboriginal title and rights to our Territory. Our aboriginal title and rights are held collectively by the shíshálh Nation, and are managed through the governance structures established by the shíshálh Nation through our own laws, customs and procedures. Only Chief and Council, and individuals properly authorized by Chief and Council, have the legal authority to act on behalf of the shíshálh Nation.
Members of the nimulh shishálh tl´extl´ax-min are not representatives of the shishálh Nation Council, and have not been authorized by Chief and Council to deal with matters affecting shishálh Nation title and rights. In the event that you are or have been contacted by any individuals, other than shishálh Nation Council, who are relying upon shishálh aboriginal title or rights, we ask that you contact Chief Garry Feschuk at the shíshálh Nation Administration so that we may address any questions you have.
